  51. My following post includes a layman's set of interpretations/opinions
  52. relative to some legal issues...Bottom line, I'm not a lawyer, but
  53. here's my opinion, treat it accordingly.

  55. First, I'm an ARRL member and a Local Gov't Liason (LGL) in the ARRL field
  56. organization, but that doesn't mean I agree with all positions of ARRL.
  57. I missed the initial thread of this discussion,but from the two recent
  58. posts it appears ARRL has threatened legal action against someone
  59. providing (or intending to provide) an "online" version of a repeater
  60. directory.  It also appears that ARRL has determined that some of
  61. the data included in this "online" directory must have been taken
  62. from the ARRL Repeater Directory because there are certain
  63. identical pieces of data that were created (e.g. a deliberate
  64. misspelling of a town name, callsign, etc.) as such in the ARRL
  65. publlished directory to use as a means of identifying data from
  66. the ARRL directory which has been used to create other databases.
  67. The ARRL then claims that using that information is a violation of
  68. their copyright on their Repeater Directory.
  69.  
  70. Hopefully I've expressed the above correctly...now I delve into my
  71. opinion.  Several years ago an almost identical situation arose
  72. having to do with an "independent" telephone white pages provider
  73. who used the white pages of one of the regional telephone companies
  74. as the source for the independent's white pages.  The independent
  75. first approached the telephone company and asked to purchase an electronic
  76. copy for the purpose, but the telephone company refused.  The 
  77. independent then just had all the data manually keypunched into its own
  78. database from an actual "hard copy" of the white pages.
  79. The telephone company was able to "prove" that the independent white
  80. page provider used the telco white pages because they had populated
  81. the telco white pages with certain "bogus" entries for that express
  82. purpose.  Not knowing of which entries were bogus, the bogus entries
  83. were readily found in the white pages of the independent white
  84. pages.  The case went all the way to the US Supreme Court.
  85.  
  86. The final resolve of the case was that the white pages was NOT
  87. protected by copyright because it was nothing more than a factual
  88. listing of data that was arranged alphabetically.  Factual
  89. information (e.g. my name, address & phone number) can not be
  90. copyrighted and the court decision said that a simple
  91. alphabetical sort/listing of that data did NOT represent a
  92. compilation that would be protectable by copyright.  Thus there
  93. is precident for using data from any source (factual data that is)
  94. in another database if there is a valid argument that the data
  95. as presented in the newly created database is either (1) not
  96. of any particularly creative arrangement (e.g. alphabetical, arranged
  97. by state, town, etc.) or (2) is arranged in a different arrangement
  98. (creatively speaking) than the data as presented in the original
  99. database (e.g. the ARRL Repeater Guide).
  100.  
  101. So, for this specific situation, it seems to me that all the
  102. individual data about any given repeater is not copyrightable
  103. by itself (e.g. input/output freq., location, callsign, attributes,
  104. etc.) and it is only the total compilation of that data for
  105. all the repeaters in a directory that
  106. MAY be copyrightable as a total work where the copyright protects
  107. a uniquely creative way of presenting the data (simple
  108. electronic sorts by band, state, and location don't...IMHO...seem
  109. to be a good example of a creative presentation).  
  110.

  308. I built an FX146 2 meter rig a while ago and I understand that there
  309. have been several articles published on various homebrew upgrades.  I've
  310. already checked the mods files on world.std.com and couldn't find any
  311. references to what I'm looking for.  Ramsey doesn't keep a list of
  312. articles either.

  314. Does anyone know sources of information on an external digital tuner
  315. (not using a PC or anything non-portable) to randomly tune throughout
  316. the FX's entire frequency range?
  317.  
  318. Also, has anyone made a subaudible side tone encoder for use with
  319. repeaters that use this technique to block spurious triggering?

  340. On some rigs, placing the radio in CW mode and then pressing the PTT on the
  341. mike will put the radio in Transmit mode but there will be no power output 
  342. until the CW key is pressed.

  446. problem with my radio (a small Sony FM/MW/SW): the only electronic equipment 
  447. customs are interested in seems to be video cameras with custom checks being
  448. of format:

  557. Interesting.  My Citation (1980) has had a couple of alternators die, and I
  558. appreciate the tip about the faint glow of the warning light, but I didn't
  559. hear any increase in noise associated with it.  It's remarkably quied for
  560. HF mobile operation.  Sorta hate to contemplate getting rid of it, but at
  561. 152,000 miles, I suspect someday it may go terminal on me.

  593. Yeah, I had read in Science magazine that Wayne was going to be publishing
  594. a new journal dealing with cold fusion.  I suspect the only subscribers may
  595. be Pons and Fleishmann (is that the right name for the other "discoverer"
  596. of cold fusion?  Workin' from memory here.), so hopefully it will cost him
  597. a bundle and will fade quickly into obscurity. Fortunately, the rest of the
  598. _scientific_ community seems to have attended the wake for cold fusion, but
  599. not these guys.

  618. Your car's computer should be shielded.  My chevy's is in a thick tin can, but
  619. the injectors are in the clear.  Your noise may be coming from an improperly
  620. shielded computer rather than EMP noise generated when your car is injecting
  621. fuel.
